1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DocMint ("Company," "we," "us," or "our") governing your access to and use of the DocMint website at docmint.io and all related services, features, and applications (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service following any changes constitutes acceptance of those changes.
2. Description of Service
DocMint provides browser-based PDF processing tools and services, including but not limited to:
- PDF merging, splitting, and organizing
- PDF compression and optimization
- PDF conversion (to/from various formats)
- PDF editing, annotation, and signing
- AI-powered document analysis and processing
- PDF security features (encryption, watermarking, redaction)
- OCR (Optical Character Recognition) capabilities
Most processing occurs locally in your browser. Certain features may require server-side processing, in which case files are handled according to our Privacy Policy.
3. User Accounts
3.1 Account Creation
Some features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may:
- Process documents you own or have permission to process
- Use the Service for personal, educational, or commercial purposes
- Create an account and access premium features (if subscribed)
- Share processed files as permitted by applicable laws
5. Prohibited Activities
You agree NOT to:
- Use the Service to process illegal, harmful, or offensive content
- Upload malware, viruses, or any malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service to infringe on intellectual property rights
- Process documents containing child exploitation material
- Engage in any activity that disrupts or interferes with the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or attempt to extract source code
- Resell, redistribute, or commercially exploit the Service without authorization
- Circumvent any security measures or access restrictions
- Use the Service in violation of any applicable laws or regulations
Warning: Violation of these prohibited activities may result in immediate termination of your account and may be reported to appropriate authorities.
6. Intellectual Property Rights
6.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by DocMint and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.
6.2 Your Content
You retain all rights to the documents and content you process through the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide the Service. We do not claim ownership of your content and do not use it for any purpose other than providing the requested services.
7. Pricing and Payment
7.1 Free and Paid Services
DocMint offers both free and paid tiers. Free users may have limitations on usage, file sizes, or features. Paid subscriptions unlock additional features and higher limits.
7.2 Billing
Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selection). You authorize us to charge your payment method for all fees incurred.
7.3 Price Changes
We reserve the right to modify pricing at any time. Price changes will be communicated in advance and will take effect at the start of the next billing cycle.
7.4 Refunds
Refund requests are handled on a case-by-case basis. If you are dissatisfied with the Service, please contact us within 14 days of purchase to discuss a potential refund. No refunds will be provided for partial subscription periods.
8. Service Availability and Modifications
We strive to provide reliable and uninterrupted service. However:
- The Service is provided "as is" and "as available" without warranties of any kind
- We may modify, suspend, or discontinue any aspect of the Service at any time
- We do not guarantee that the Service will be error-free or uninterrupted
- Scheduled maintenance may temporarily affect availability
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
10. Disclaimers and Limitations of Liability
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCMINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY.
10.3 Maximum Liability
Our total liability to you for any claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.
11. Indemnification
You agree to indemnify, defend, and hold harmless DocMint and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your content or documents processed through the Service.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Violation of applicable laws or regulations
- Conduct harmful to other users or the Service
- Request by law enforcement or government agencies
- Extended periods of inactivity
Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or through your account settings.
13. Dispute Resolution
13.1 Informal Resolution
Before filing any formal dispute, you agree to contact us and attempt to resolve the dispute informally. Most disputes can be resolved quickly and satisfactorily through communication.
13.2 Arbitration Agreement
Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration, except that either party may bring individual claims in small claims court. The arbitration shall be conducted in accordance with applicable arbitration rules.
13.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Delaware.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and DocMint regarding the Service and supersede all prior agreements and understandings.
